Portera ORDINANCE NO. 9683 AN ORDINANCE CLOSING AND ABANDONING ALLEYS LOCATED NORTHWEST FROM HOUSTON STREET, NORTHEAST FROM EAST 5TH STREET, AND SOUTHEAST FROM LINDSAY STREET MORE PARTICULARLY DESCRIBED HEREIN, UPON CERTAIN CONDITIONS. _______________________ SECTION 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby closed and abandoned alleys located northwest from Houston Street, northeast from East 5th Street, and southeast from Lindsay Street, more particularly described herein, and as shown on plat attached hereto and made a part hereof by reference: An alleyway varying in width and beginning on the northwest line of Houston Street 100 feet southwest of the intersection of the northwest line of Houston Street with the southwest line of East 4th Street, said point being the southeast corner of lot 8, Subdivision of the McConnell Home Place, as shown by plat of record in plat book 5, page 9, R.O.H.C., thence southwest 10 feet with Houston Street to the northeast corner of lot 7, said subdivision, thence northwest 90 feet with the northeast line of said lot 7, thence southwest 290 feet with the northwest line of lots 7, 6, 5, 4, 3, 2, and 1, to the northeast line of East 5th Street, thence northwest 10 feet with East 5th Street to the southeast corner of lot 14, thence northeast 275 feet with the southeast line of lot 14 to the northeast corner thereof, thence northwest 100 feet with the northeast line of lot 14 to a point in the southeast line of lot 13 which is 15 feet southwest of the northeast corner of said lot 13, thence northeast 25 feet with the southeast line of lot 13, and continuing with the southeast line of lot 8 on East 4th Street, Lindsay's Extension of the Town of Chattanooga, as shown by plat of record in deed book K, volume 1, page 433, R.O.H.C., to the southwest corner of lot 12, said McConnell subdivision, thence southeast 200 feet with the southwest line of lots 12, 11, 10, 9, and 8, to the northwest line of Houston Street, the point of beginning. An alleyway varying in width and beginning on the southeast line of Lindsay Street 190 feet southwest of the intersection of the southeast line of Lindsay Street with the southwest line of East 4th Street, said point being the southwest corner of lot 4, Hickman's Subdivision of Lot Number Six on East Fourth Street Lindsay's Addition to Chattanooga, as shown by plat of record in plat book 5, page 3, R.O.H.C., thence southeast 85 feet with the southwest line of said lot 4, thence at a 135 degree angle northeast some 7 feet, thence at a 135 degree angle northeast 55 feet with the southeast line of lots 4 and 3, said Hickman's Subdivision to the northeast corner of lot 3, thence at a right angle southeast 10 feet to the northwest line of lot 8 on East 4th Street, Lindsay's Extension of the Town of Chattanooga, as shown by plat of record in deed book K, volume 1, page 433, R.O.H.C., thence southwest 50 feet with the northwest line of said lot 8 to a point 20 feet northeast of the southwest corner of said lot, thence southeast 50 feet parallel to, and at all points 20 feet northeast of, the southwest line of said lot 8 to a point in the northwest line of lot 13, Subdivision of the McConnell Home Place, as shown by plat of record in plat book 5, page 9, R.O.H.C., said point being 20 feet northeast of the southwest corner of said lot 13, thence southwest 20 feet with the northwest line of said lot 13 to the southwest corner thereof, said point being in the center of the northeast line of lot 7 on East 5th Street, said Lindsay's Extension, thence northwest 150 feet with the northeast line of lots 7 and 5 on East 5th Street, said Lindsay's Extension, to the southeast line of Lindsay Street, thence northeast 10 feet with Lindsay Street to the southwest corner of lot 4, said Hickman's Subdivision, the point of beginning. Tax Map No. 135M-H-7, 8, and 10-27. SECTION 2. BE IT FURTHER ORDAINED, That this closure and abandonment is made subject to the following conditions: 1. The Electric Power Board of Chattanooga has distribution facilities located within said rights-of-way which must be maintained for the use and benefit of its customers and an easement the width of the entire right-of-way is reserved for the operation, maintenance, rebuilding, and replacement of these distribution facilities. 2. The areas reserved for utility easements must be kept free and clear of all structures. 3. All existing easements are retained. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage as provided by law.
